This information is intended for all individuals who interact with the Site's web pages, both those who use the Site without registering and those who, following a specific procedure, register on the Site and use the online services provided through it.
THE DATA CONTROLLER
The Data Controller is Marco Negri, Via Vittorio Emanuele 56 - 25019 Sirmione Centro Storico (BS) - Italy
PERSONAL DATA SUBJECT TO PROCESSING
In addition to what is provided on other pages (in particular with reference to "Cookies"), we inform you that through the Site and the use of its features and/or subscription to the services provided therein, the following data may be collected and processed for the purposes further specified below:
- navigation data: this is data that the server automatically records each time you visit the site, such as the name of the provider, the site from which you access the site, the pages visited, the date and duration of the visit, and the IP address of the device;
- common personal and identifying data: this category includes name and surname, address, email address, date of birth and any additional contact information provided by completing the electronic forms published from time to time on the Site;
- data on the user's orders and the purchasing process, such as the IP address from which the transaction originated, the time of the request, the type of browser used, as well as information regarding the product selected and the object of the purchase, the shipping and/or billing address, any complaints or right of withdrawal exercised regarding the purchase made through the Site.
LEGAL BASIS AND PURPOSE OF DATA PROCESSING
The processing of personal data is based on the existence of a contractual or legal obligation or, as applicable and as further specified in the following paragraph, on the existence of a legitimate interest of the Company or on the user's consent, which is optional and revocable at any time, and is aimed exclusively at achieving the following purposes:
(i) fulfillment of contractual obligations - to ensure registration on the Site and the correct provision of the services requested through the Site and/or via forms made available therein, and, therefore, to correctly and promptly fulfill all obligations arising from pre-contractual and contractual relationships established with you, expressly including any requests for support and assistance for online purchases, management of returns, withdrawals, or complaints. This expressly includes administrative and accounting purposes related to and in any case arising from the contract concluded with you, including with regard to the possible electronic transmission of commercial invoices by companies providing e-commerce services (including, by way of example, the refund procedure for the price paid and the issuance of a credit note following withdrawal and the return of the purchased product);
(ii) in compliance with legal obligations – to fulfill obligations arising from the law or from national and/or EU regulations in force, including in the tax field, as well as from provisions issued by competent authorities and bodies;
(iii) pursuant to a legitimate interest of the Company consisting in the legal defense of a right or interest before any competent authority or body; to allow the Company to directly offer products or services similar to those previously purchased (so-called soft spamming), limited to the email address you provided in the context of a previous purchase of a product and unless you object to such processing;
(iv) on the basis of consent for the sending of advertising material relating to the Company's products and/or services, as well as for the measurement of customer satisfaction with the quality of the services provided and the activities carried out by the Company and for the performance of statistical analyses and market research, via email (so-called marketing purposes).
MANDATORY OR OPTIONAL NATURE OF DATA PROVISION
Providing data for the purposes referred to in points (i) (fulfillment of contractual obligations), (ii) (fulfillment of legal obligations), and (iii) (legitimate interest of the Company) of Article 3 above is purely optional. However, since such processing is necessary to allow registration on the Site and the provision of services offered through the Site, failure to provide such data, or the partial or incorrect provision of such data, will make it impossible, as the case may be, to register on the Site and use the online services and, in general, to execute the contractual relationship established or already established and/or to fulfill the obligations set forth in the contract or applicable law, or to process your specific requests. This will also make it impossible for the Company to send you general information on products or services similar to those previously purchased, to conduct market research, including to assess user satisfaction and thus improve its services, or otherwise to pursue its legitimate interests (such as the defense of its rights in court). With reference to the processing purposes indicated in point (iv) above (consent for marketing), the provision of data is purely optional and the related processing is based on consent, which is optional and revocable at any time. Failure to provide your consent will not affect your ability to register on the Site and use the services available therein, and will only result in the inability to receive advertising material relating to the Company's products and/or services. Consent for the purposes described above (marketing purposes) may be revoked at any time. Revocation of consent is only valid for the future and has no effect on processing that occurred prior to the withdrawal (where based on consent). Furthermore, limited to the purpose referred to in point (iii) of Article 2 above (so-called soft spam), we remind you that you may object to the processing of your data by sending an email to the address indicated at the bottom of this document.
DATA COMMUNICATION
The data may be communicated to the following categories of subjects (“recipients”):
- to all those subjects (including Public Authorities) who have access to personal data by virtue of regulatory or administrative provisions;
- to all those public and/or private entities, natural and/or legal persons to whom communication is necessary or functional to the correct fulfillment of a contractual or legal obligation;
- to banks and companies that manage national or international payment circuits through which online payments for products purchased through the Site are made. In addition to the foregoing, for the purposes described in Article 3 above, personal data may be disclosed to parties that provide services to the Company, such as, by way of example and not limited to,
- to companies or third parties responsible for printing, packaging, shipping and/or delivery of promotional and advertising material;
- to companies, consultants or professionals possibly responsible for the installation,
maintenance, updating and, in general, management of the Site's hardware and software;
- to companies or Internet providers responsible for sending documentation and/or information material,
- to the Company's professionals, auditors, legal or tax consultants, who will process the data, as applicable, as data controllers or external data processors. The data may also be accessed by the Company's employees and collaborators (particularly the E-commerce, Marketing, Sales, Customer Care, and Finance departments), as well as the Company's partners and directors, as "authorized persons."
STORAGE OF PERSONAL DATA
Your personal data will be stored as specified below:
- for the marketing purposes referred to in point (iv) of Article 3 above, for the period of time permitted by law and the provisions of the Italian Data Protection Authority (Supervisory Authority), as set forth in the provision regarding "Loyalty cards and consumer guarantees. The rules of the Italian Data Protection Authority for loyalty programs" of February 24, 2005, as amended;
- Except as indicated above, your data will be processed and stored for the entire duration of the contractual relationship and, subsequently, for the maximum period established by applicable laws regarding the statute of limitations on rights and/or forfeiture of legal action (including administrative and tax matters) and, in general, for the exercise/defense of the Company's rights in disputes brought by public authorities, public entities/entities, and private parties.
MINORS UNDER 14 YEARS OF AGE
The Site does not contain information, features, or services directly intended for users under the age of 14. Minors must not provide information or personal data without the consent of their parent or guardian. Therefore, all users under the age of 14 are advised not to disclose their personal data under any circumstances without the prior authorization of a parent or guardian. If the Company becomes aware that personal data has been provided by a minor (under 14), the Company will immediately destroy such data or request specific consent from the parents (or guardian). The Company also reserves the right to deny access to the services available on the Site to any user who has concealed their minority or who has otherwise disclosed their personal data without the consent of their parents (or guardian).
RIGHTS OF THE INTERESTED PARTIES
Pursuant to Regulation (EU) 2016/679, the data subject has the right to (i) access the data and specific information on the processing, such as, by way of example, the purposes, the categories of data being processed, the existence of the other rights indicated below and to request a copy of the data themselves, (ii) rectify the data, (iii) erase the data without undue delay in the cases provided for by the same Regulation, such as in the case of opposition to the processing and if there is no overriding legitimate interest for the processing by the Data Controller (this right does not apply if the processing is necessary for the fulfillment of a legal obligation or for the exercise and defense of a right in court), (iv) request the restriction of the processing, (v) object at any time, for reasons relating to his particular situation, to the processing based on a legitimate interest of the Data Controller, (vi) receive the data in a structured, commonly used and machine-readable format (portability) and to transmit them to another controller in the cases provided for by the Regulation. This Privacy Policy may be subject to changes and updates, including those resulting from changes in applicable law. Any changes or updates will be notified to users by posting them on the Site's home page and will be applicable and binding from that moment. The Company therefore invites users to periodically visit this page to learn about any changes or updates.
Cookie Policy
PREMISE
This Cookie Policy is drafted and provided to supplement the information already provided pursuant to Art. 13 of EU Regulation 2016/679 and published on the website www.artigianatosirmione.com. It also complies with the provisions of the Provision of the Italian Data Protection Authority of 8 May 2014 concerning "Identification of simplified procedures for providing information and obtaining consent regarding the use of cookies" and subsequent amendments and additions.
The data controller is L'Artigianato Sirmione, Via Vittorio Emanuele 58 - 25019 Sirmione Centro Storico (BS) - Italy.
WHAT ARE COOKIES?
A "cookie" is a small text file created by some websites on your computer when you access that site. It is used to store and transport information. Cookies are sent from a web server (the computer running the website you're visiting) to your browser (Internet Explorer, Mozilla Firefox, Google Chrome, etc.) and stored on your computer. They are then sent back to the website on subsequent visits.
Cookies are generally distinguished as follows:
- based on the entity that installs them on the user's terminal, depending on whether it is the same operator of the site the user is visiting (so-called "first-party cookies") or a different site, which installs the cookies via the first site (so-called "third-party cookies");
- based on their duration, in persistent cookies, which remain stored on the user's device even after the browser is closed and until a pre-set expiration date (for example, cookies used to maintain authentication on the site, avoiding the need to re-enter authentication credentials), and in session cookies, which are not stored permanently but are automatically deleted every time the browser is closed;
- based on the purpose of each cookie: some cookies allow the website that installed them to remember, for example, the preferences expressed by the user while browsing or making a purchase or for authentication (so-called "technical cookies" or "strictly necessary cookies") and are necessary for the proper functioning of the site or the services enabled or requested by the user; some cookies and similar technologies are provided for the purpose of processing statistical information on the use of the site and its functioning in order to measure its performance and thus improve its usability (so-called "analysis and measurement cookies"); finally, other cookies allow the site that installed them to monitor the user's browsing activity, including for the purpose of sending advertising or offering services in line with the preferences expressed by the user while browsing the web and/or evaluating the usefulness of advertising campaigns and content presented to the user (so-called "profiling cookies" or "marketing cookies").
WHICH COOKIES ARE USED BY THE SITE AND FOR WHAT PURPOSES?

DO I NEED TO ACCEPT COOKIES?

Pursuant to applicable law, the Data Controller is not required to request user consent for the use of first-party technical and/or analytical cookies, as they are necessary to provide the services requested through browsing the Site.
